Win for Borrowers in 2nd District Appellate Court

The Second District Appellate Court made a decisive ruling in favor of borrowers yesterday by setting aside 21 mortgage foreclosure judgments and sales.  The Court indicated that a Bank must strictly comply with the relevant Illinois statutes in order to properly acquire jurisdiction in a mortgage foreclosure case and provided borrowers with a concrete avenue to collaterally attack judgments entered without personal jurisdiction over the parties.
